One of the moms on my homeschool board posted that her kids had found this fellow and had put him in an aquarium to observe-she was wondering whether it would be safe to let them keep him a few days and how to care for him while they have him.
 
I'm sure someone will be along with a better guess and some care info, but looks like a Dekay's snake or a garter snake. Harmless, either way!
 
Looks like a garter to me. Also appears either kinked or injured 1/2 way down its body.
 
It does look closer to a brown than a garter I think as well, but Chip is definitely right it looks like it has a bad kink half way down its body which could be a cause for concern both with attitude and taking care of the little guy.
 
The poor guy looks like he was hit with a pvc pipe...


On another note, When I lived in Lexington a friend of my parents caught one of these and gave it to me. We kept it in our class at school until summer when my mom told the teacher to let it go. We never did find out what species it was.
 
That snakes body looks weird indeed! Like the lower end of the body has not developed fully.... How did it survive??? Or is it just the photo and his pose perhaps?
 
You're right Snake especially with the drastic change in coloration, it almost looks like an issue between healthy live tissue and decaying tissue but the snake seems normal in the picture minus the extreme kink.
 
Except that I don't think decaying flesh looks like that... it looks more like something that he already had at birth, the color did not develop perhaps.
 
I had a bearded dragon that was paralyzed by her sibling as a baby, her tail and legs never developed proper coloration either. Perhaps the color controllers were damaged here? It may well be related to that kink.
 
Definately a Brown (DeKay's) Snake. They are tricky to keep in captivity compared to Garter Snakes. They need a humidity gradient and are rather secretive.
